Privacy Policy of Outdoorchef AG
1. SCOPE
1.1 This Privacy Policy provides users with information about the type, extent and purpose of collection and the use of data by the provider and controller Outdoorchef AG, Eggbühlstrasse 28, 8050 Zurich, Switzerland (hereinafter the “Provider”) on its website (hereinafter the “Website”).
1.2 The legal principles of data protection can be found in the Federal Data Protection Act (DSG).
2. PROCESSED DATA
2.1 LOG DATA
The Provider (or its webspace provider) collects data every time the Website is accessed (so-called server logfiles). The access data includes: name of the web page accessed, file, date and time of access, data volume transferred, report of successful access, browser type and version, user’s operating system, referrer URL (the site visited previously), IP address and the requesting provider (hereinafter “Log Data”).
The Provider uses the Log Data only for statistical evaluations for the purpose of operation, security and optimisation of the Website. However, the Provider reserves the right to check the Log Data retrospectively if, for example but not exclusively, there are legitimate suspicions of unlawful use based on specific evidence.
2.2 PERSONAL DATA
Personal data is pieces of information with the aid of which a person can be identified, i.e. data that can be traced back to a specific person. This includes name, email address and telephone number and data about preferences, hobbies, memberships and websites accessed, among other things (hereinafter “Personal Data”).
Personal Data is collected, used and passed on by the Provider only if this is permitted by law or the user has consented to data collection.
2.3 DATA FOR THE PURPOSE OF MAKING CONTACT
When contact is made with the Provider (for example using the contact form or by email), the user’s details are saved for the purpose of processing the enquiry and in case there are follow-up questions.
2.4 DATA FOR THE NEWSLETTER
The newsletter informs users about the Provider’s offers.
In order to send out the newsletter, the Provider requires a valid email address from the user and information that makes it possible to verify that the user is the owner of the email address provided and that its owner has agreed to receive the newsletter. No other data is collected. This data is used only to send out the newsletter and is not passed on to third parties.
On registration for the newsletter, the IP address and date of registration are saved. This is done exclusively as evidence in case an email address is misused by a third party or used to register for the newsletter without the knowledge of the legitimate owner.
The user’s consent to storage of the data and the email address and to its use to distribute the newsletter may be withdrawn at any time. Withdrawal may be completed via a link in the newsletters themselves, in the user’s profile area or by sending a message using the contact options specified here.
3. INCLUSION OF SERVICES AND CONTENT OF THIRD PARTIES
It may be that third-party content is included on the Website, for example but not restricted to YouTube videos, map materials from Google Maps, RSS feeds and graphics from other websites. This always requires the providers of such content (hereinafter “Third-Party Providers”) to see users’ IP addresses. The IP address is therefore required to display this content. The Provider makes every effort to use content for which Third-Party Providers use the IP address only to deliver that content. However, the Provider has no control over Third-Party Providers if, for example, they store IP addresses for statistical purposes. If the Provider is aware of this, he/she will notify the user.
The Provider offers no guarantee regarding the correctness of information relating to the services and content of Third Party Providers and the information provided here does not constitute an obligation or acceptance of liability on the part of the Provider.
4. COOKIES
Cookies are small files that make it possible to store specific, device-related information on the access device of users (PC, smartphone, etc.). On the one hand, they improve the user-friendliness of websites and benefit users (e.g. by storing login information). On the other, they are used to record statistical data about website usage that can be analysed to improve the Website. Users can control the use of cookies. Most browsers have an option that can be used to restrict or completely prevent storage of cookies. It should be noted, however, that use of the Website, in particular its user-friendliness, is restricted without cookies.
Users have the option to manage many online advertising cookies from companies via the US site http://www.aboutads.info/choices/ or the EU site http://www.youronlinechoices.com/uk/your-ad-choices/.
5. USE OF GOOGLE ANALYTICS
Google Analytics is a web analysis service of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter “Google”). Google Analytics uses so-called “cookies”, text files stored on your computer that allow analysis of your use of the Website. The information generated by the cookie about your use of this Website is usually transferred to a Google server in the USA and stored there.
If IP anonymisation is activated on the Website, your IP address is first truncated by Google within Member States of the European Union or other states that are parties to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transferred to a Google server in the USA and truncated there. IP anonymisation is activated on the Website. On behalf of the operator of this Website, Google uses this information to analyse use of the Website, compile reports about Website activities and provide other services associated with use of the Website and the internet for the Website operator.
The IP address sent by your browser in the context of Google Analytics is not combined with any other Google data. Users can object to storage of cookies by configuring the corresponding setting in their browser software; the Provider wishes to point out, however, that in this case some of the functions of the Website may not be available to their full extent. In addition, users can prevent collection of the data generated by the cookie relating to their use of the Website (including their IP address) by Google and processing of this data by Google by downloading and installing the browser plug-in available from the following link
http://tools.google.com/dlpage/gaoptout?hl=en.
As an alternative to the browser add-on or in browsers on mobile devices, this link can be used to prevent data collection by Google Analytics on the Website in future. An opt-out cookie is placed on the user’s device in this case. If the user deletes cookies, the link must be clicked on again.
The Provider offers no guarantee regarding the correctness of information relating to Google Analytics and/or Google and the information provided here does not constitute an obligation or acceptance of liability on the part of the Provider.
6. USE OF FACEBOOK SOCIAL PLUGINS
Facebook Social Plugins is a service of the social network www.facebook.com, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (hereinafter “Facebook”); it uses social plugins (hereinafter “Plugins”). The Plugins can be identified by one of the Facebook logos (white “f” on a blue tile or a “thumbs up” symbol) or by the words “Facebook Social Plugin”. The list and appearance of the Facebook Social Plugins can be seen here:
https://developers.facebook.com/docs/plugins/.
If a user opens a page of the Website that includes a Plugin of this sort, the browser establishes a direct connection to the Facebook servers. The content of the Plugin is sent directly to the user’s browser by Facebook and is integrated into the Website by it. The Provider therefore has no control over the extent of the data that Facebook collects with the aid of this Plugin and thus provides information to users to the best of its knowledge.
Through integration of the Plugins, Facebook is notified that a user has opened the corresponding page of the Website. If the user is logged in to Facebook, Facebook can link the visit to the user’s Facebook account. If users interact with the Plugins, by clicking on the Like button, for example, or posting a comment, the corresponding information is sent directly to Facebook by the user’s browser and is saved there. If a user does not have a Facebook account, there is still a chance that Facebook will have access to their IP address and store it. According to Facebook, only an anonymised IP address is stored in Switzerland.
Users can obtain information about the purpose and extent of data collection, subsequent processing and use of the data by Facebook and users’ rights and setting options to protect their privacy from Facebook’s privacy policy at:
https://www.facebook.com/about/privacy/.
If a user has a Facebook account and does not want Facebook to collect data about them through this Website and link it to their account data held by Facebook, they must log out of Facebook before visiting the Website.
It is also possible to block Facebook Social Plugins with add-ons for browsers, such as “Facebook Blocker”.
The Provider offers no guarantee regarding the correctness of information relating to Facebook Social Plugins and/or Facebook and the information provided here does not constitute an obligation or acceptance of liability on the part of the Provider.
7. USE OF TWITTER
The Website uses buttons of the Twitter service. These buttons are offered by Twitter Inc., 795 Folsom St., Suite 600, San Francisco, CA 94107, USA (hereinafter “Twitter”). They can be identified by terms such as “Twitter” or “Follow”, combined with a stylised blue bird. With the aid of the buttons, it is possible to send a tweet or share a page of this Website or to follow the Provider on Twitter.
If a user opens a page of the Website that includes a button of this sort, the browser establishes a direct connection to the Twitter servers. The content of the Twitter buttons is sent directly to the user’s browser by Twitter. The Provider therefore has no control over the extent of the data that Twitter collects with the aid of this Plugin and thus provides information to users to the best of its knowledge. To the best of its knowledge, only the user’s IP address and the URL of the Website are transferred when the button is pressed, but they are not used for purposes other than to display the button.
You can find further information about this in Twitter’s privacy policy at http://twitter.com/privacy.
The Provider offers no guarantee regarding the correctness of information relating to Twitter and the information provided here does not constitute an obligation or acceptance of liability on the part of the Provider.
8. WITHDRAWAL, CHANGES, RECTIFICATIONS AND UPDATES
The user has the right to obtain information from the Provider free of charge about the data it processes.
The user also has the right to rectification of incorrect data, blocking and erasure of their Personal Data, unless there is a statutory retention obligation that prevents this.
